NOTICE TO FPFI CREDITOR TRUST BENEFICIAL HOLDERS

Due to increased class action litigation activity and expenses the FPFI Creditor Trust does not have sufficient Available Cash to
make a distribution in 2010 and 2011.
The Trustee does anticipate that there will be future distributions but at this time is unable to determine exactly when nor how much future
distributions will be.
